AN ORDINANCE GRANTING A SPECIAL PERMIT USE OF LOT
2 BEDELL SUBDIVISION TO THE CITY OF WEST MEMPHIS,
ARKANSAS (208 WEST JACKSON AVENUE); AHD DECLARING
AN EMERGENCY.
WHEREAS, application has been made to the City Planning
Commission to allow a Special Permitted Use of a specialized
health care facility in a R-2 Low Density Residential District,
as required by Ordinance 1258, as amended.
WHEREAS, after Notice had been published for the time and
in the manner as provided by Ordinance No. 1258,

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
SECTION I: That the following described property, to wit:
Lot 2 Bedell Subdivision to the City of West Memphis,
Crittenden County, Arkansas, (being located at 208
West Jackson Avenue)
be, and the same hereby is granted a Special Permit Use permitting
the usage of the specialized health care facility with the special
conditions as follows:
1. Two single one-story structures with approximately 10146
square feet.
2. Hot to exceed ten (10) patients per building.
3. Not to exceed two curb cuts for Lot 2 - with approval by
City Engineer.

SECTION II: That all Ordinances or parts of Ordinances in
conflict herewith are hereby repealed.
SECTION III: That it had been found and determined by the
City Council of the City of West Memphis, that this property is in
the process of being the facility of the specialized health care
facility and made available for public use and the immediate
passage of this Ordinance is necessary for the development and use
of said property for the purposes of a specialized health care
facility. That the Council is of the opinion that the passage of
the same is necessary for growth and expansion of the City of West
Memphis, Arkansas, and in the interest of the public health,
peace, safety and welfare of the City of West Memphis and the
inhabitants thereof. Therefore, an emergency is hereby declared
to exist and this Ordinance shall take effect and be in full force
and effect immediatel~y/~upon its passage and approval.
