AN ORDINANCE GRANTIIQG A SPECIAL PERMIT USE OF LOTS 46, 47
and 48, BLOCK 134, KENDAL SUBDIVISION TO THE CITY OF WEST
MEMPHIS, ARKANSAS (1601 - 1605 EAST BROADWAY); AND
DECLARING AN EMERGENCY.
WHEREAS, application has been made to the City Planning
Commission upon the rezoning of said property to C-1, General
Commercial District, for a Special Permit Use of the upper floors
of the building located on said property for multiple far_mily dwelling
containing six (6) apartments; and,
WHEREAS, after Notice had been published for the time and
in the manner as provided by Ordinance No. 1258, the matter was
heard by the City Planning Commission and the Planning Commission
recommended that a Special Permit Use be granted to said property
to permit the upper floor of the same to be used for multi-family
dwellings, containing not more than six (6) apartments;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
SECTION I: That the following described property, to-wit:
Lots 46, 47 & 48, Block 134, Kendal Subdivision to the
City of West Memphis, Crittenden County, Arkansas,
(being located at 1601 - 1605 East Broadway)
be, and the same hereby is granted a Special Permit Use, permitting
the useage of the upper floor of said building as a multiple family
dwelling containing not more than six (6) apartments.
SECTION II: That all Ordinances or parts of Ordinances in
conflict herewith are hereby repealed.
SECTION III: That it has been found and determined by the
City Council of the City of West Memphis, that this property is
in the process of being completely renovated and made available
for public use and the immediate passage of this Ordinance is
necessary for the development and use of said property for 'the
purposes for which constructed. That the Council is of the opinion
that the passage of the same is necessary for the growth and
expansion of the City of West Memphis, Arkansas, and in the interest

and the inhabitants thereof. Therefore, an emergency is hereby
declared to exist and this Ordinance shall take effect and be in
full force and effect immediately upon i passage d approval.
